Trumped up Charges Lead to 45 days in Jail on September “Snow Closure”
Procedural Abuse. Veteran political strategist and Roundhouse angel David Alcon spent 45 days in jail on trumped up charges related to a romantic dispute, the Sun News has learned. Mr. Alcon was highly regarded within the New Mexico Kucinich campaign in 2004 and went on to a steady job with Majority Leader Ken Martinez’s office at the State Capitol. Not only did Alcon lead the Kucinich campaign strategy in 2004, he was instrumental in assisting the efforts of Senator Jerry Ortiz y Pino to pass a Resolution impeaching President Bush and Vice President Cheney in the 2007 Legislative Session. Mr. Alcon’s lawyer was not available for comment and Deputy District Attorney David Foster would not discuss an ongoing matter. The wrongful nature of the imprisonment would not be so obvious but for the invocation of a snow day in September as a justification for filing the “enlargement of time” motion. Court documents the Sun News has obtained clearly indicate that a Grand Jury was allegedly cancelled due to “snow closure,” on or about September 6th. Furthermore, the court documents suggest that defendant Alcon was remiss for not appearing at a hearing on September 4th. But Mr. Alcon was in jail at the time. Sun News Legal Counsel indicate that Mr. Alcon has 90 days to file a Tort Claim under the New Mexico Tort Claims Act and that his Federal Civil Rights appear to have been violated under 42-USC Section 1983.
